General

1. These delivery conditions apply to the formation, content and fulfillment of all agreements concluded between the client and Silke-Amsterdam.

 

2. When placing the order, the customer agrees to the general terms and conditions.

 

3. Silke-Amsterdam reserves the right to change the general terms and conditions at any time.

 

4. No rights can be derived from the product photos. Because we are dealing with handmade products, it is possible that a product differs minimally from product photos in matters such as color, size or shape.

 

Price

1. All prices quoted are exclusive of sales tax (VAT) and other levies imposed by the government.

 

2. All prices quoted are exclusive of shipping costs.

 

3. The price that Silke-Amsterdam has stated for the performance to be performed by it applies exclusively to the performance in accordance with the agreed specifications.

 

4. Offers are valid while stocks last and / or during the promotional period.

 

5. Silke-Amsterdam is not liable for typos in its website. No rights can be derived from unlawful price information.

 

Price changes

1. Silke-Amsterdam is entitled to increase the agreed price if one or more of the following circumstances occur after the conclusion of the agreement: increase in the costs of materials, semi-finished products or services required for the implementation of the agreement, increase of shipping costs, of wages, of employer's social security contributions, of the costs associated with other employment conditions, the introduction of new and increase of existing government taxes on raw materials, energy or residues, a significant change in currency ratios or, in general, circumstances that affect one or more others are comparable.

 

2. Extra laborious text, unclear copy, unclear sketches, drawings or models, faulty information carriers, faulty computer software or data files, faulty method of delivery of the materials or products to be delivered by the client and all similar deliveries by the client that Silke-Amsterdam require more activities or costs than could reasonably be expected when entering into the agreement, are grounds for increasing the agreed price. Extraordinary or reasonably unforeseeable processing difficulties arising from the nature of the materials and products to be processed are also grounds for increasing the agreed price.

 

3. Silke-Amsterdam is entitled to increase the agreed price or be obliged to lower the price if the client makes changes to the originally agreed specifications, including author's corrections or changed instructions after receipt of working drawings, models and typesetting, printing and other tests. Silke-Amsterdam will cooperate with these changes within the limits of what is reasonable, if the content of the performance to be performed by it does not deviate substantially from the originally agreed performance.

 

Cancellation

1. The client is entitled to cancel an agreement before the supplier has commenced the performance of the agreement, provided that he compensates the damage caused by this for the supplier. This damage includes the losses suffered and lost profits by the supplier and in any case the costs that the supplier has already incurred in preparation, including those of reserved production capacity, purchased materials, services invoked and storage.

 

2. It is possible to cancel an order if this happens within 24 hours after the order has been placed and if the order has not yet been shipped. You can only report this cancellation by e-mail.

 

3. When canceling a paid order or an item from an order, the following administration costs will be charged to the customer:

a) € 10.00 when canceling or returning per item from an order.

b) Unpaid orders can be canceled free of charge within 24 hours.

 

Payment

1. Payment takes place via the payment methods offered on the website.

2. If payment is not made within 3 days, the order will be canceled.

 

Shipping costs

1. The shipping costs for orders with an order value lower than € 100, = excluding VAT, are for the account of the customer. In that case, the shipping costs are € 7.00 excluding VAT. For orders with an order value of € 100 excluding VAT or higher, no shipping costs will be charged.

 

2. When exchanging / returning the shipping costs of returning these items are for the customer's own account.

In case of an exchange, Silke-Amsterdam will charge shipping costs of € 7.00 excluding VAT for the item to be resent.

 

Delivery

1. Silke-Amsterdam outsources the home delivery of the orders to PostNL. Orders are shipped via PostNL.

 

2. Silke-Amsterdam strives to ship orders 4 days after receipt of payment. Exceptions to this are force majeure, holidays and products that are not in stock. In case Silke-Amsterdam is closed for holidays, this will be clearly indicated on the Silke-Amsterdam website.

 

3. Silke-Amsterdam will do everything possible to deliver accepted orders as soon as possible. If the delivery is delayed - whether due to being temporarily out of stock, or for other reasons - or if an order cannot be executed or only partially, the customer will be notified. In that case, the customer has the right to cancel the remaining order in writing.

 

4. Silke-Amsterdam is not liable for any damage you may suffer because the order has been delivered to an address incorrectly specified by the customer.

 

Exchange and Returns

1. If an item does not meet your expectations, there is the option to exchange or return the item.

 

2. The postage costs as well as the shipping risk for return shipment are at the expense of the customer.

 

3. The following conditions apply to returns and / or exchanges:

a) After delivery of your order, you have 14 days to exchange or return the items. After this period the purchase can no longer be canceled and is final.

b) The goods must be in their original condition, ie returned in the original packaging.

c) With your return shipment, you must send a letter with your details and the order number.

d) Insufficient or non-stamped returns will not be accepted by us, regardless of the reason for the return.

f) When an item is exchanged, the shipping costs of the item to be resent must be paid in advance to Silke-Amsterdam.

g) In case of return (cancellation of purchase of 1 or more articles), the amount to be returned (excl. shipping costs and minus administration costs) will be transferred to you within 30 days or as soon as possible.

 

Stock

1. All candles are available from stock. However, it may happen that an item is temporarily out of stock or that it has been sold out due to a larger number of orders than normal. You will be informed of this by us as soon as possible. In this case, the customer has the right to cancel the order without charge. Silke-Amsterdam will arrange for a refund in this case.

 

Warranty and Liability

1. Silke-Amsterdam guarantees that the goods to be delivered meet the usual requirements and standards that can be set for them and are free from any defects.

 

2. As proof with regard to the warranty you will receive a packing slip from Silke-Amsterdam as proof of purchase.

 

3. The guarantee referred to in this regard does not apply if the defect has arisen as a result of injudicious or improper use or if, without written permission from Silke-Amsterdam, you or third parties have made changes or attempt to make changes to the item or have them. used for purposes for which the item is not intended.

 

4. If the delivered good does not correspond with what was agreed and this non-conformity is a defect within the meaning of the product liability regulation, Silke-Amsterdam is not liable for the resulting consequential damage.

 

5. The provisions in these general terms and conditions with regard to warranty, do not affect your warranty claims under the law, all with due observance of the provisions in these general terms and conditions and the agreement, including the nature and quality of what has been sold to you. and delivered.

 

Privacy

1. Your personal data will be included in the Silke-Amsterdam customer database. We use your personal data to execute the agreement, to conduct responsible customer management, risk management and for marketing purposes. We do not provide data to third parties that affect your privacy. If you no longer wish to receive commercial offers from us, you can confirm this to us by e-mail.

 

Copyright image and text material

1. It is not permitted, without written permission, to copy, save, publish, reproduce or otherwise use text and / or images. Legal proceedings will be followed in case of violation.

 

Applicable law
1. The agreement between Silke-Amsterdam and the client is governed by Dutch law.
